Text For Citation: 01 Item/Group: 001 Hazard: LIFTING
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina : The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a)unsafe operation of equipment/machinery. Street Department workers were not given instruction and training in safe methods of operation before being assigned to operate the rear loader container lifting system on refuse collection truck # 84 prior to the accident at Hobgood Academy on July 30, 1997. ¿Ref. ANSI Z245.1- 1995 paragraph 6.1 a)! "Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide the instruction and training as prescribed in ANSI Z245.1-1992 paragraphs 6.1 and 6.2."
