Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a falling tree during tree removal operations: Jobsite: On or about 2/15/99 employees were exposed to the hazard of being struck by a falling tree during tree removal operations. Among other methods, one means of correction of this hazard is to develop and implement safe work procedures as detailed in American National Standards Institute, ANSI Z133.1-1988 American National Standard for tree care operations; "Pruning, trimming, repairing, maintaining, and removing trees and cutting brush safety requirements". Paragraph 8.5.3 "all workers not directly involved in an operation shall be kept clear of the work area".
