Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to internal injuries, fractures, or death from possible collapse of poultry barn: In the following instance, employees were not removed from the hazard of a possible collapse of a poultry barn. Approximately three weeks prior to the June 11, 2002 collapse of the north end of Barn #27, the structural integrity of the northeast side floor, wall, and foundation were known to be compromised. At least one dozen workers worked in this barn between May 28, 2002 and June 11, 2002, including a group of at least ten employees working in the north end of this barn 16 hours prior to its collapse. Among other methods, one feasible and acceptable method of abatement to correct this hazard is to evaluate all structures at the farm and replace or reinforce defective roofs and roof components, walls, and foundations.
