Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recogn ized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the conditions listed below: Focus Logistics, Inc. & 28B Leigh F ischer Blvd: On or before 01/23/04 forklift operators were allowed to operate fo rklifts without wearing the safety belt provided. Recognition of the hazard of p owered industrial truck tipover and the need for the use of an operator restrain t system is evidenced by certain requirements for powered industrial trucks in A SME B56.1-1993-Safety Standard for Low Lift and High Lift Trucks. This condition exposed employee(s) to the hazard of being struck should the fork lift accident ly run into an object and result in the driver being thrown out of the operator seat. A feasible and acceptable abatement method to correct this hazard would be to ensure that operator(s) wear supplied safety belts anytime they operate an i ndustrial fork lift truck.rial
