Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: "in the alternative" 29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of job sites, materials, and equipment to be made by a competent person. a)Mammoth Cave Visitor's Center - On or about 04/07/11, employees were exposed to struck-by hazards when the employer did not ensure that pump truck was set up safely and correctly. Among other methods, one feasible and acceptable means of abatement would be to the follow the American Concrete Pumping Association (ACPA) Safety Bulletin: Setting Outriggers to Prevent Accidents which states, "The contractor needs to supply a safe set-up area where the soil is capable of supporting the outriggers and there are no voids, pipes or other hidden dangers." In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
