Title 23 V.S.A. Chapter 3, subchapter 5, Section 223(a): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Location: Throughout Violation: The employer had not furnished a place of employment that was free from hazards that were likely to cause death or serious physical harm, in that employees were exposed to fire/explosion hazards while using flammable liquid adhesives while carpet laying. The employer had not provided a mechanical means of ventilation for dispersal of the accumulated flammable vapors, nor had an assessment of the work area been accomplished to insure that all sources of ignition were properly identified and controlled. One reasonable and acceptable method to correct this hazard is to thoroughly evaluate the work area for sources of ignition prior to allowing employees to disperse the flammable adhesive and to provide a mechanical means of ventilation to disperse an accumulation of flammable/explosive fumes.
