Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being caught in or crushed by a structural collapse: Location: 50 Partridge Road White Plains NY On or before 6/30/98, a) The employer fabricated steel roof trusses with marginal welds. The welds were placed with little penetration and were discontinuous and showed lack of fusion at places. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: 1) To conform to American National Standard Institute/American Welding Society's Standards on Complete Joint Penetration Groove Welds when welding the steel roof trusses at the bottom chord splice locations (reference ANSI/AWS D1.1-94 Structural Welding Code). 2) To have shop drawings approved prior to the fabrication of steel roof trusses. 3) To fabricate the steel roof trusses in accordance with the contract drawings. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement of this violation as normally required by 29 CFR 1903.19.
