Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling approximately 5 feet from a pallet supported by the forks of a Grant forklift: Location: Abitino Pizzeria On or about 12/29/97, a) An unguarded platform supported by the forks of a Grant forklift was used to raise and lower employees installing metal framing. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: To use a safety platform secured to the lifting carriage and/or forks as stipulated by ANSI B56.1-1975, sections 427 and 513A, American National Standard for Power Industrial Trucks (lowlift and highlift trucks). NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement of this violation as normally required by 29 CFR 1903.19.
