Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were expose to: The hazards of falling out of the front bucket of a backhoe while it traveled along a roadway. Location: North State Road (North Side), Briarcliff Manor NY ON OR ABOUT 06/05/9745 a) Employee was exposed to the hazard of falling out of the front bucket of a 1996 Ford Backhoe # A 438025 as it traveled north on North State Road, employee was riding in the front bucket holding onto plants that were in the bucket. AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS: (1) Prohibit employees from riding in the bucket at any time for any reason. 2)To follow the Ford manufactures, Operator's Manual regarding the Safety Precautions, item 26 page iii states, Do not transport anyone in the loader bucket. (3)To follow the New Holland Operator's Manual, section on operating the machine item, 24 page 1-10 states, Do not transport anyone in the loader bucket. (4)FIEI Safety Manual (Farm and Industrial Equipment Institute), for operators and mechanics for Backhoe/ Loader, page 21 states, WARNING: YOUR BACKHOE/LOADER IS A ONE PERSON MACHINE. NEVER PERMIT RIDERS.
