Text For Citation: 01 Item/Group: 001 Hazard: UNAPEQUIP
Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The collapsing of a masonry wall, the employer was not competent to evaluate the structural integrity of a masonry wall, prior to or after the completion of the enlargement. Location: 7 Welles/ 62 Warburton Avenues Yonkers, NY On or About: 04/23/97 (date of accident) & The employer enlarged an existing door opening in an existing wall that was not approved by the Engineer of Record. The employer was not competent to determine the structural adequacy of the framing needed to support the larger opening and the manner of erecting such framing so as to prevent the compromise of structural integrity of the existing wall. AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE METHOD TO COREECT THIS HAZARD IS: A) The General Contractor will request details of structural changes to be made to an existing masonry wall from the structural engineer or a competent person before enlarging the opening. Note: No abatement certification is required.tion
