Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Section 35(a)(1) of the Virgin Islands Act of 1973: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On August 8, 2005, an employee was operating a Great Dane, Chariot Deck, Serial Number TCM052C03003 52" driving mower without the roll-over protection structure (ROPS), which resulted in employee death. Among other methods, one feasible and acceptable abatement method to address this hazard is to: a) install the rollover protective structure (ROPS) as originally provided with this driving mower by the manufacturer, and to install ROPS on any other similar protective devises. b) develop and implement an effective training program for the mower operators which incorporates, at a minimum, that operators read the operator's manual and are trained in the safe operating practices for the mowers and in the recognition of potentially hazardous operating conditions before allowing operator to use equipment.
