Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of fire and explosion. On or about July 21st, 1999 and at times prior thereto, an employee was permitted to cut on a fuel tank that had not been cleaned so thoroughly as to make absolutely certain that there are no flammable materials present or any substances which when subjected to heat, might produce flammable or toxic vapors. Among other methods, feasible and acceptable abatement methods to correct this hazard would be to thoroughly clean the inside of tanks and purge with inert gas before cutting as per ANSI Z49.1-1967 Safety in Welding and Cutting. __ Abatement certification or documentation is NOT required for this item. __ Abatement certification is required for this item. x_ Abatement certification and documentation are required for this item. __ Warning tag (or citation copy) required on this equipment before moving.
