Section 5(a)(1) of Public Law 91-596, the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to: hazard of being struck by pieces of PVC pipe and or compressed air from broken PVC pipe on the wall throughout the work facility. (a)Throughout facility - The service lines used to supply compressed air, at approximately 125 PSI, were made of PVC pipe, a material not designed for this purpose because it shatters upon failure of the material from external damage. The PVC piping was not encased to protect the employees. Feasible Abatement Method: 1.One feasible abatement method but, not limited to would be to replace the piping with one made of material designed for that purpose or to enclose the PVC pipe within a conduit that would contain the debris in case the PVC pipe fails and shatters.
