Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employee was exposed to being struck by the sides and/or ends of the Polar Aluminum Cargo Tank serial no. H1-8129 when compressed air was being used to test for leaks in repairs being made to the tank on or about 9-12-97. Among other methods, one feasible and acceptable method to correct this hazard is to use water instead of compressed air to test for leaks.
