Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a)At this construction site area an employee was found traveling and working inside a frontal bucket of a digger (from another company digger Ford New Holand 555C -unit no0B20B tractor no.A4097 DF9P1Z) to reach an upper landing surface (3 floor building roof) and bring up concrete blocks. Employee exposed to fractures, lacerations, cuts, strucks by with digger, and similar type of injuries. Among others one feasible and acceptable abatement method to correct this hazard is to develop and implement an effective safety program. a)En esta area de trabajo en constriccion un empleado fue encontrado viajando y trabajando dentro del cubo de una excavadora (perteneciente a otra compania- excavadora Ford New Holand 555C- unidad no OB2OB tractor no.A4097 DF9P1Z) para alcanzar la superficie de descanso superior (techo de edificio de 3 pisos) y subir bloques de concreto. Empleados expuestos a fracturas, laceraciones, cortaduras, atrapamiento entre excavadora y lesiones similares. Ademas de otros un metodo factible y aceptable para corregir este riesgo lo es el desarrollar e implementar un programa de seguridad efectivo.
