Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being struck by moving vehicles: a)On or about August 21, 1996 on the waiting line for the tipping floor employees were exposed to being struck by moving trucks. The driver of a garbage ("packer") truck on the waiting line got out of his truck, was struck and knocked down by a passing truck and was pinned under the wheels of another truck and crushed to death. ABATEMENT NOTE: Among others, a feasible method to eliminate or to materially reduce this hazard is to establish a procedure to require drivers and helpers to remain in their trucks while on the facility unless they are actually engaged in dumping at the tipping floor.
