Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of falling up to 4 stories and/or being struck by falling debris: a)1350 Broadway, New York, N.Y. - The employer failed to ensure that the parapet from which the "Spider" model ST-180 power driven scaffold was suspended had the structural integrity necessary to support the imposed loads as determined by a licensed professional engineer; on or about August 5, 1996. ABATEMENT NOTE: Among other methods, one feasible and acceptable means of abatement would be to have parapets and similar building structural components used to support suspended scaffolds certified by a licensed professional engineer as required in the New York Department of Labor Industrial Code Rule 21(part 21.9) and Rule 23 (part 23-5.8).
