Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of operating a Komatsu WA500-1 wheel loader with the bucket raised above the required traveling height: a)Yard area. An employee was operating a Komatsu WA500-1 wheel loader with the bucket raised 29" above the manufactures traveling height; on or about 9/1/99. Among other methods one feasible and acceptable abatement method to correct this hazard is as follows: 1.Ensure that the operators are familiar with the manufactures manual which states, "Bring the work equipment in the traveling posture" and depicts the machines bucket to ground clearance at no more then 50cm/19".
