Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling trusses as a result of the trusses not being braced in accordance with the requirements of the Truss Plate Insitute. Hillcrest Development did not ensure that there was an engineered truss bracing plan for the wood trusses that had a clear span of 84 feet. One feasible abatement method would be to: Follow the recommendations of the Truss Plate Institute HIB-91 and have an engineer design a bracing plan when the truss clear span is over 60 feet.
