Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees. Oilers employed by this employer were exposed to the hazard of being crushed under a moving crane while traveling on rail tracks. These employees were allowed to ride on the crane outside of the two operator cabs and without means to keep them from falling or being thrown off of the crane.
