Section 5(a)(1) of the Occupational Safety and Health Act of 1970: Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by falling concrete floor slab from above level: (a) On or about April 7, 1997 employee working on the second floor level of the Wingate Inn Motel construction site was fatally crushed by falling concrete floor slab. Slab number E-73 fell after slab E-8 was erected and set on concrete walls. The supporting angle irons (lentil's) were unattached and the embed plates were not installed; consequently, the angle irons were not welded. One feasible and acceptable corrective method to this hazard was to follow the instructions and details provided by the blue prints.
