Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a moving vehicle that was not equipped a backup alarm where the vehicle was operated in reverse and where there was an obstructed view to the rear. One feasible method to correct this hazard is insure that the vehicle is equipped with an audible backup alarm that is loud enough to be distinguishable from the surrounding noise levels: A) LOCATION: ESTABLISHMENT THE LEACH PACKMASTER, SERIAL # 2RII-31-4D, WAS NOT EQUIPPED WITH A WORKING BACKUP ALARM WHERE THE VEHICLE WAS OPERATED IN REVERSE AND WHERE THERE WAS AN OBSTRUCTED VIEW TO THE REAR FROM THE OPERATORS CAB.
