Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) ...being thrown off or falling and being run over, in that employees were permitted to ride on the outside of the Mi-Jack Translift 1000 R cabs contrary to the manufacturer's recommendations and the employer's own safety rules. Among other methods, a useful and feasible mean to abate is to establish a procedure to ensure that the company's safety rules are followed. This could be achieved by: 1. Communicating to all employees the actual rules which must be followed. 2. Ensure that supervisors understand, follow, and enforce the safety rules. 3. Promptly and firmly address deviations from the company's safety regulations. 4. Conduct periodic random inspections to evaluate the degree of compliance. 5. When such evaluations indicate a need, implement corrective action.ive
