Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards. Employees that operated Caterpillar forklifts, with installed rollover protection, did not use/wear the installed seat belts. a.Materials Handling Yard --- Employees operating Caterpillar forklifts, numbers V90E # 3 and FT4, equipped with rollover protection and seat belts, did not wear the installed seat belts when operating the forklifts. One feasible and acceptable method, among others, to correct this hazard would be to have the operators wear the seat belts.
