Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of falling off an backhoe due to provisions to carry passengers other than the operator were not available on the backhoe: a.Jobsite - A Caterpillar 416CIT backhoe bucket was used to transport a passenger into and out from an excavation. ABATEMENT NOTE: To transport employees, vehicles which are equipped with a seat and seat belt for each passenger must be used. (Abatement certification is not required.)
