Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of falling off an excavator due to provisions to carry passengers other than the operator were not available on the excavator: a.Interstate 93 Exit 25 Off Ramp - A Caterpillar 330 Excavator bucket was used to transport a passenger into and out from an excavation. ABATEMENT NOTE: To transport employees, vehicles that can safely handle passengers should be used.
