Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a. Receive serious injuries due to overturned of the machine into an excavation 20 feet in depht. An employee used an excavator trademark Samsung, model: 210LC, serial # SBY1136 to lift a concrete tube 3 feet wide x 16 feet long and 430 pound aproximately. Among other methods, one feasible and acceptable abatement method to correct this hazard is to used a crane to lift the concrete tube. a. Recibir heridas serias debido a volteo de la maquina en una excavacion de 20 pies de profundidad. Un empleado usaba una excavadora marca Samsung, modelo: 210 LC # de serie: SBY1136 para levantar un tubo de concreto de 3 pies de ancho x 16 pies de largo, de 430 libras aproximadamente. Entre otros metodos, un metodo aceptable y posible para corregir este riesgo es usar una grua para levantar el tubo de concreto.
