Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards while repositioning a loaded pallet on the storage racks or retrieving merchandise. a)Warehouse building, on or about September 25, 1997 an employee was fatally injured when he fell of a pallet which had been elevated using a Crown fork lift truck. The pallet was not provided with: 1)A skid resistant surface. 2)Provision to protect personnel in the normal working position from moving parts of the truck that represent a hazard. 3)Restraining means such as rails, chains, cable, etc. or a means for securing an operator tether. 4)The pallet was not secured to the lifting carriage and/or forks. Among other methods, one possible and acceptable abatement method to correct this hazard is to insure the elevatable personnel platform for use with powered industrial trucks be designed and used in accordance with ANSI B56.1-1975, American National Standard-Safety Standard For Powered Industrial Trucks. Specifically paragraphs 427 and 513.
