Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees (flagmen) were exposed to the hazard of being struck by moving railroad cars. (a)On or about 05/05/97, an employee (flagman) was fatality injured when struck by a moving railroad car. Among other methods one feasible and acceptable method of abatement would be for the Track Mobile operator to have visual and radio contact with the flagman at all times while moving railroad cars. If visual or radio contact is lost the spotter operator would immediately stop the rail cars.
