Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) An employee was exposed to an engulfment hazard while working on the discharge conveyor below day storage bin #1 at ADM Processing in Velva, North Dakota. Among other methods, one feasible and acceptable method to correct this hazard would be to stay within the initially designed storage specification of 1.4 million pounds. (b) An employee was exposed to an engulfment hazard while working on the discharge conveyor below day storage bin #2 at ADM Processing in Velva, North Dakota. Among other methods, one feasible and acceptable method to correct this hazard would be to stay within the initially designed storage specification of 1.4 million pounds. (c) An employee was exposed to an engulfment hazard while working on the discharge conveyor below day storage bin #3 at ADM Processing in Velva, North Dakota. Among other methods, one feasible and acceptable method to correct this hazard would be to stay within the initially designed storage specification of 1.4 million pounds. (d) An employee was exposed to an engulfment hazard while working on the discharge conveyor below day storage bin #4 at ADM Processing in Velva, North Dakota.
