Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical to employee(s) in that employees were exposed to the hazards of a fire and/or explosions. The design of the dairy feed pellet dryers, as referenced in NFPA 61, 6-3.1 1995, Standard of the Prevention of Fires and Dust Explosions in Agricultural and Food Products Facilities, allowed product to accumulate inside the dryer creating a condition where spontaneous ignition was likely to occur. Among other feasible and acceptable methods to correct this hazard would be to modify the dairy feed pellet dryers and pelletizing system to prevent accumulation of product inside the dairy feed dryers.
