Text For Citation: 01 Item/Group: 001 Hazard: CAUGHT
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to injury when operating a forklift without using a seat belt: (a)On or about May 20, 1997 and times prior thereto, a operator of a Toyota forklift did not wear the seat belt when operating his forklift in the storage yard. The operator was exposed to injury from being thrown from the seat if a wheel dropped in a hole or being caught between the cage and the pavement should the forklift tip over as the yard had dips and holes in the paved surface.
