Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard: a.Employees were exposed to the hazard of being struck by the end of the four (4) part wire rope line which was supporting the boom/"A" Frame on the King Fisher Marine Service, Inc., Anchor Barge 82, at the Marine Docks off of Hwy. 316, Port Lavaca, Texas. The employer did not perform complete annual inspections of floating cranes/derricks and its associated equipment such as on Anchor Barge 82 and maintain dated and signed written records with a determination made as to whether deficiencies constituted a safety hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to implement a complete annual inspection program with dated and signed written inspection records and reports of floating cranes/derricks and its associated equipment such as required by American Society of Mechanical Engineers (ASME) Standard ASME B30.8-1993, Chapter 8-2 Inspection, Testing and Maintenance, Section 8-2.1, Inspection - General, Sub-Section 8-2.1.1, Paragraph b, page number 19; Sub-Section 8-2.1.2 Frequent Inspection, page number 19; Sub-Section 8-2.1.3 Periodic Inspection, page number 19 and Sub-Section 8-2.1.5 Inspection Records, page number 20. b.Employees were exposed to the hazard of being struck by the end of the four (4) part wire rope line which was supporting the boom/"A" Frame on the King Fisher Marine Service, Inc., Anchor Barge 82, at the Marine Docks off of Hwy. 316, Port Lavaca, Texas. The employer did not maintain monthly, dated and signed written inspection records and reports on rope condition, i.e. reduction of rope diameter below nominal diameter; number of broken outside wires; worn outside wires, corroded or broken wires at end connections; corroded, cracked, bent worn or improperly applied end connections and severe kinking, crushing, cutting or unstranding with a determination made as to whether deficiencies constituted a safety hazard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to implement a regular monthly inspection program with dated and signed written inspection records and reports on rope condition as required by American Society of Mechanical Engineers (ASME) Standard ASME B30.8-1993, Chapter 8-2 Inspection, Testing and Maintenance; Section 8-2.1, Inspection - General; Sub-Section 8-2.1.1, Paragraph b, page number 19; Sub-Section 8-2.1.2, Frequent Inspection, page number 19; Sub-Section 8-2.1.3, Periodic Inspection, page number 19; Section 8-2.4, Rope Inspection, Replacement, and Maintenance; Sub-Section 8-2.4.1, Frequent Inspection, page number 21; Sub-Section 8-2.4.2, Periodic Inspection, page number 22; Sub-Section 8-2.4.3, Rope Replacement, page number 22; Sub-Section 8.2.4.5, Inspection Records, page number 23 and Sub- Section 8-2.4.6, Rope Maintenance, page number 23. c.Employees were exposed to the hazard of being struck by the end of the four (4) part wire rope line which was supporting the boom/"A" Frame on the King Fisher Marine Service, Inc., Anchor Barge 82, at the Marine Docks off of Hwy. 316, Port Lavaca, Texas.
