Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: In the construction of the pilaster # 39 of one excavation of 20' of depth approximately in front of the Prudencio Rivera Martinez Building, 505 Munoz Rivera Ave., Hato Rey- one employee of the NECSO-REDONDO,S.E. but not of the side of the construction, was exposed to the hazard of fall, with minimum illumination and minimum space to work, letting him enter to the danger area of the excavation, when the excavator- Komatsu 220 was operating and the excavation was without the protection of the barricade. Among other methods, one feasible and acceptable abatement method to correct the hazard is to have the competent person of the excavation in the area when they are working without the barricade such for not permit the entrance to any foreign person to the excavation. Hazard: fall. En la construccion de la pilastra # 39 de una excavacion de 20' de profundidad aproximadamente - al frente del edifico Prudencio Rivera Martinez, Ave. Munoz Rivera 505, Hato Rey - un empleado de la compania NECSO-REDONDO, S.E., pero no del proyecto, fue expuesto al riesgo de caida, con iluminacion minima y espacio minimo de trabajo, dejandolo entrar al area peligrosa de la excavacion, cuando la excavadora - Komatsu 220 estaba operando y la excavacion estaba sin la proteccion de las barricadas. Entre otros metodos,uno factible y aceptable de corregir este riesgo es tener la persona competente de la excavacion en el area cuando esten trabajando sin las barricadas para asi no permitir la entrada a ninguna persona ajena a la excavacion.
