Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: At the excavation located in the north side and adyacent to the marginal street in the Museo de Arte de Puerto Rico Proyect, employees were installing storm sewer pipes inside the excavation. The meassurements of the excavation were : 20 feet depth, 20 feet width, 8 feet wide at the base or bottom, and 54 feet length. There was an engaged Caterpillar excavator, model 320 BL inside of the excavation. The excavator was used to bring in and take outside the employees to the excavation. Among other methods to correct this hazard is, the use of the guidelines expecified in the standard OSH 1926.651(c)(2). Hazards: Employees falling from the excavator bucket. En la excavacion localizada en el lado norte y adyacente a la marginal en el proyecto Museo de Arte de Puerto Rico, empleados estaban instalando tubos de alcantarillado pluvial dentro de excavacion. Las medidas de la excavacion eran las siguientes : 20 pies de profundidad, 20 pies de ancho, 8 pies de ancho en la base o fondo y 54 pies de largo. Habia una maquina excavadora marca Caterpillar, model 320 BL prendida dentro de la excavacion. La excavadora se usaba para entrar y sacar a los empleados en la excavacion. Entre otros metodos de correccion para corregir este riesgo es, seguir las guias especificadas en la norma 1926.651(c)(2). Riesgo : Empleados caigan del "bucket" de la excavadora.
