Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: The hazards associated with the movement of locomotive(s) and/or rail road car(s). On or before May 9, 1997, at the Timken Faircrest Plant in Canton, proper procedures were not developed, documented and utilized for the control of hazards associated with not maintaining a clear distance from potential moving locomotives and unguarded rail road cars. Failure of the company to require employees to maintain a clear distance resulted in the exposure of two employees to the hazards of the equipment they were working on being struck by a railroad car and causing severe injuries to both employees. Among other methods, one feasible and acceptable method to control the hazard is to establish a policy requiring employees to maintain a clear distance from tracks on which locomotives are operating and proper training of employees to ensure the employees understand and maintain a clear distance from locomotive operations. Proper procedures and training shall include the following: 1. Proper training to ensure all employees understand that a clear distance must be maintained from all locomotive and railroad car operation.
