Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of vehicular accidents due to inadequate monitoring and training of personnel: (a)Establishment: The employer had not provided adequate instruction and training in safe methods of work to employees who operate, clean, service, maintain, and/or repair mobile refuse collection and compaction equipment. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop and implement programs, in the language necessary, to monitor and train employees in accordance with American National Standard for Refuse Collection, Processing, and Disposal Equipment-Mobile Refuse Collection and Compaction Equipment-Safety Requirements, ANSI Z245.1-1992. Abatement Note: Employee training shall be provided to ensure that all company policies and procedures are understood by employees and followed, to include the requirement for Personnel Protective Equipment.
