Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by an inadequately secured ceiling panel of a Smart Box while working underneath it on or about 5/20/96. (a) Establishment: During disassembly of a Smart Box, four bolts which hold the ceiling panel in place were removed prior to securing the panel to ensure that it would not fall down onto the employees. Among other methods, one feasible and acceptable method of abatement would be to develop, implement, and enforce the use of a formal procedure for safely disassembling these pieces of equipment. Before the ceiling panel bolts are removed, the panel could be secured in place by the use of a sling attached to an overhead crane. The panel could then be lowered to the ground safely after the bolts are removed.
