Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about October 15, 1985, employees were exposed to an atmosphere likely to cause death or serious physical harm when they were required to enter a confined space subject to the accumulation of toxic contaminants and/or and oxygen deficient atmosphere. Among other methods, one feasible and acceptable abatement method to correct this hazard is to wash out the tank with water, ventilate and test the atmosphere with a portable oxygen and combustible gas analyzer prior to and during entry procedures.
