Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) The hazard of machinery malfunction, in that the employer did not provide periodic inspection to ensure the operating integrity of the boom lift cylinder on the Sterling pounder. Structural changes on this equipment were made to facilitate its operation without the written instruction of the manufacturer nor the advice of a qualified engineer. Among other methods - One feasible and acceptable abatement method to correct this hazard is: a) Institute a program of recorded maintenance inspections. b) Obtain the manufacturer's written instruction and the advice of a qualified engineer prior to performing structural changes.
