Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Potential hazards of fire, burns, inhalation of toxic gases and chemicals and asphyxiation from the improper operations of the waste material incineration system. The employer did not ensure that the designed operating procedures for the Kelly Pyrolytic Incinerator Model 1280 were followed and did not provide training for all supervisors and maintenance employees who operate the equipment to assure the handling and incineration of waste material within the design limitations of the equipment. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow and enforce the operating recommendations in the Owner/Operator Manual for the Kelly Pyrolytic Incinerator and to train supervisors and employees who operate the equipment in those procedures.
