Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of being overcome in a confined space and of not being able to be rescued from the confined space while removing #6 oil sludge from a metal, underground tank (20' x 79' x 89') due to lack of means of escape or rescue. Among other methods, one feasible and acceptable abatement method to correct this hazard is to establish and enforce adequate confined space entry procedures which would include, as a minimum the following essentials: 1) Condust atmospheric testing of confined spaces for flammable atmospheres and oxygen deficient atmospheres prior to each and entry. 2) Provide adequate rescue procedure and a qualified or standby person for rescue purposes.
