Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being hit by a tractor before they were able to leave the danger zone between the unhitched tractor and trailer. Horizon Lines container yard, row 210: The employer did not require that the vehicle drivers waiting for mechanics working on trailers park their rigs perpendicular to the container and that the drivers wait until the mechanics leave the danger zone before aligning their vehicle with the trailer and look again to ensure that there is no one between the rig and the trailer before releasing the brakes and reversing to hitch up to the trailer.
