Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) The employer did not protect employee(s) from the recognized hazard of electrocution by contact with energized 4.3KV North Phase, overhead electrical conductor. Employees were exposed to this hazard when in the process of rotating mobile "Bazooka" screw conveyor counter clockwise near energized electrical line at the facility located Loop 461, South, in New Deal, Texas, on or about November 8, 1985. The employer could have protected his employee(s) by lowering the screw conveyor to minimum height, or by other equivalent means.
