29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not provided to the operator when the operator has been involved in an accident or near-miss incident. (a) On or about December 9, 2025, and times prior to, the employer exposed employees to a struck-by hazard, in that a PIV operator did not receive refresher training and an evaluation after being involved in an accident on October 1, 2025. (b) On or about December 9, 2025, and times prior to, the employer exposed employees to a struck-by hazard, in that a PIV operator did not receive refresher training and an evaluation after being involved in an accident on October 2, 2025. (c) On or about December 9, 2025, and times prior to, the employer exposed employees to a struck-by hazard, in that a PIV operator did not receive refresher training and an evaluation after being involved in an accident on November 3, 2025. (d) On or about December 9, 2025, and times prior to, the employer exposed employees to a struck-by hazard, in that a PIV operator did not receive refresher training and an evaluation after being involved in an accident on November 7, 2025.
