29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On or about September 17, 2025, employees conducting roofing activities on a residential home structure to include tear-off, and shingle installation were not protected from falling to the lower level by a personal fall arrest system, or other means of fall protection. This exposed employees to a fall hazard of 9-feet 10-inches to 16-feet onto grass. (b) On or about September 17, 2025, employees conducting roofing activities on a residential detached garage structure to include tear-off, and shingle installation were not protected from falling to the lower level by a personal fall arrest system, or other means of fall protection. This exposed employees to a fall hazard of 9-feet 10-inches to 16-feet onto concrete. Bayron Alexander Garcia was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1821243, citation number 1, item number 3, and was affirmed as a final order on December 11, 2025, with respect to a workplace located at 1028 Arrowwood Ct. Pewaukee, WI. 53072.
