Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. The hazards of being struck by and/or run over while working and/or moving near heavy equipment. The factory installed right and left side rear view mirrors of the Komatsu Motor Grader, Model GD605A-3, Serial 57137, were not maintained in good repair to enable the operator to view movement of workers near the right and left side rear areas of the machine prior to and/or during reverse travel. The left side rear view mirror was missing and the right side rear view frame was bent and the mirror glass was missing. On or about March 25, 1993, an employee was struck and run over by the motor grader after he had moved into the path of the grader to pick up debris. Among other methods, one feasible and acceptable abatement method to correct this hazard is... inspect and maintain all equipment as prescribed by the manufacturer to ensure that all standard equipment/safty devices are inspected regularly, properly used and correctly attached in the prescribed position, i.e., "rear view mirrors shall be checked for positioning, dirt and damage."
