Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) Employees are exposed to the hazard of electrical shock, in that, the 235 back hoe was operating within 10 feet of the overhead high voltage electrical lines. Among others, one feasible method to correct this hazard is to stay 10 feet back from the electrical lines. this hazard occurred on or about February 13, 1991.
