Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On April 22, 1992 employees were exposed to hazard of being thrown from cab of skidder where seat belts are not provided. Approximately 8.9 miles SSE of Woodville on Tommy Whitaker Rd., Caterpillar Skidder Model No. 518, Serial No. 50S1954 was being operated in rough terrain and steep grades without seat belts. Among other methods, one feasible and acceptable method to correct this hazard is to install and maintain seat belts per manufacturers specifications contained in operation and maintenance manual.
