Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazrd of falling while riding on lowered tailgate of pickup truck with no firmly secusred seat or seatbelt. Employee was riding on tailgate of pickup loaded with unsecusred highway construciton wrning sign for Highway 84 West of brookhaven: Among other methods, feasible and acceptable abatement method to correct this hazard are to require personnel to ride within the occupant space provided or have seats and seat belts firmly secured and adequate for the number of employees to be carried.
